Two ordered to trial in pedestrian’s death

CLAREMORE, Okla. (AP) – Two brothers are being ordered to trial for second-degree murder in the death of an 18-year-old Claremore woman who was struck by a vehicle while walking near Verdigris.

A Rogers County judge on Tuesday ruled that there is enough evidence to send 19-year-old Gage Shriver and 21-year-old Dakota Shriver to trial for the death of Noelle New and injuries to 19-year-old Maranda Talley. The Shrivers’ mother — 39-year-old Annette Butanda — was also ordered to trial on a charge of being an accessory.

New was killed and Talley injured in June when they were struck by a pickup truck while walking on a county road about 3:15 a.m.

Attorneys for the brothers say the two are "overcharged" with second-degree murder and that they were unaware they had struck the girls.
