Tonkawa Resident Arrested

Tonkawa-OK resident Rusty Wayne Burger (64), was arrested by Tonkawa Police on Monday, July 30,
2024.

Investigators with the Tonkawa Police Department and the Oklahoma State Bureau of Investigations (OSBI) met with Burger at his place of employment at Wheatheart Nutrition Center in Tonkawa. Burger was arrested by Tonkawa Police, following the interview, on complaints of sexually related offenses against children, at approximately 12:54 p.m.
Chief Nick Payne stated that the Tonkawa Police Department received the initial criminal complaints from a juvenile male victim on July 27, 2024. Tonkawa Police Lt. Aaron Jones [as stated in the Probable Cause Affidavit], Burger is alleged to have committed these sexually based offenses over the last two years. Lt. Jones further reported that most of these offenses are alleged to have occurred when the victim was 14 years old.
Tonkawa Police coordinated with the OSBI, Internet Crimes Against Children (ICAC), and the 8th District Attorney’s Office prior to and after Burger’s arrest. Chief Nick Payne stated that Burger was taken into custody, without incident. He was booked into the Kay County Detention Center, the following afternoon.

Burger is charged with felony counts of Lewd Molestation, Forcible Sodomy, Rape by Instrumentation, Rape by Digital Penetration, Contributing to the Delinquency of a Minor, Violation of the Oklahoma Computer Crimes Act, and Solicitation of a Minor for Sex.
On Thursday, Burger appeared in Kay County District Court, before Judge Wilkie and bond was set at $200,000.00 and was ordered to have no contact with the victim or other minors. Burger is scheduled for Initial Appearance, in Kay County District Court, on August 9, 2024.

Chief Nick Payne reports that this is an ongoing investigation. All persons arrested are presumed innocent until proven guilty in a court of law.
