Pro Tem Paxton Bill to Strengthen Penalty for Drive-By and Shooting into Buildings Advances

OKLAHOMA CITY – Pro Tem Lonnie Paxton, R-Tuttle, Tuesday advanced legislation that would add discharging a firearm at or into a dwelling or building used for public or business purposes to the state’s list of 85% crimes.

Senate Bill 631 passed through the Senate Public Safety Committee, reinforcing Oklahoma’s commitment to holding violent offenders accountable. The bill includes language that ensures individuals who willfully or intentionally discharge a firearm or other deadly weapon into a dwelling is an 85% crime.

Pro Tem Paxton said the bill enhances public safety and gives district attorneys and law enforcement officials discretion on when to take action.

“Right now, if you step out of a vehicle to shoot into a house, this crime is treated different than a drive-by shooting,” Pro Tem Paxton said. “This legislation ensures that individuals who recklessly and intentionally endanger lives by firing into homes, businesses or public buildings face the serious consequences they deserve. By adding this crime to the list of 85% offenses, we are sending a clear message that such violent actions will not be tolerated in Oklahoma. This will also give law enforcement and district attorneys the proper tools they need to hold these criminals accountable.”

Under the provisions of Senate Bill 631, a perpetrator shall be charged with a felony and is punishable by imprisonment from two to 20 years. Offenders convicted of this crime would be required to serve at least 85% of their sentence before being eligible for parole or early release. The bill builds upon existing statutes aimed at reducing violent crime and protecting Oklahomans in their homes and communities.

Senate Bill 631 will now be considered by the full Senate on the Senate Floor.
