Oklahoma Supreme Court Issues Ruling Regarding Sex Offender Residency Near Parks

The Oklahoma Supreme Court rules sex offenders cannot live within 2,000 feet of a city park, even if they registered before the regulation became law.

The court battle comes after an El Reno man who was convicted of rape was told by police he could not purchase a property that was 300 feet from a park, as it would violate the Sex Offender Registration Act.

The man, Kelly Donaldson, sued the City of El Reno in 20-21, claiming the rule did not apply because he registered as a sex offender a year before the law took effect.

In a 5-to-3 decision, justices ruled the law does apply retroactively.
