Oklahoma Supreme Court Rules Marijuana-related State Questions Can Move Forward

The Oklahoma Supreme Court ruled that two marijuana-related State Questions can move forward.

State Question 819 seeks to create a new article to the Oklahoma Constitution that would legalize, regulate and tax the recreational use of marijuana by adults age 21 and older.

State Question 818 seeks to replace the Oklahoma Medical Marijuana Authority with the Oklahoma State Cannabis Commission and expand the statutory framework regarding the regulation and taxation of medical marijuana.

The State Questions now go to the Secretary of State who will decide when to open up the signature-gathering phase.

Once that date is set, proponents will have 90 days to get 95,000 signatures. That’s eight percent of the population who voted in the last general election for governor.

After that, there will be timeframes for counting signatures and determining their validity.

If everything checks out, the two State Questions could end up on the November ballot.
