Prosecutors call Tulsa shooting justified

TULSA, Okla. (AP) – Prosecutors have determined a Tulsa police officer was justified in the fatal shooting of a man suspected in a convenience store shooting before leading officers on a chase.

The Tulsa World reports that District Attorney Steve Kunzweiler on Tuesday cleared Officer Dean Montgomery in the fatal June shooting of 37-year-old Eric Portillo.

Kunzweiler found that Montgomery was justified in shooting because he was trying to arrest a suspect in a felony involving a gun.

Police have said Portillo had pistol-whipped and shot at a man at the convenience store before later firing a gun during the police pursuit in east Tulsa. Police say Portillo was still carrying the gun as he fled the vehicle being pursued by police and tried to run into a neighborhood.
