Utility Authority trustees to consider paying nearly $1 million to Equity Bank

During the Ponca City Utility Authority meeting following Monday’s City Commission meeting, trustees will consider and vote to conduct an executive session for trustees to meet with the City Attorney on pending contract claims over the operation of the former Ponca City Aquatic and Family Center – YMCA.

The City Attorney advises that public disclosure will impare the ability of the trustees to process the claim and any possible litigation authorized by the trustees in the public interest.

Following the executive session, the trustees will consider and vote to pay the claim of Equity Bank (successor to Eastman National Bank) in the amount of $992,500 in principal and $3,446.36 in accrued interest, based on the Young Men’s Christian Association (YMCA)’s encumbrance in favor of Eastman National Bank, under paragraph 2(A)(3) of Addendum No. 3 to the recreation center’s operating agreement.

An item on the PCUA consent agenda includes a contract for the Wentz Water Tower exterior over-coating project with Luckinbill, Inc., of Enid. The proposed contract is for $39,920. As a consent agenda item, the contract is considered a non-controversial proposal which would be approved along with the Feb. 25, 2019, minutes and a resolution for the payment of claims.

In the City Commission meeting, which begins at 5:30 p.m., City Commissioners will deal with a Charter Item, which is the election of a Vice Mayor in accordance with provisions of Section 60 of the City Charter.

A consent agenda item during the meeting is to consider and vote on a request from Ponca City Main Street for a variance to the Alcoholic Beverage Ordinance. The variance would allow for the serving of 2 oz. craft beer samples by licensed home brewers in a designated event area at the First Annual Brew Fest, to be held Saturday, May 4, on Central Avenue between Third and Fifth Streets and on Fourth Street west of the City Central Building.

On the commission’s regular agenda is an ordinance which would rezone a tract of land located at 109 West Prospect Avenue from R-2 two-family residential to C-2 General Commercial. This item willl be preceeded by a public hearing on the request.
