Affidavit in shooting case describes encounter

An affidavit filed in the shooting case of Marcus Lee Miller describes how witnesses interviewed about the shooting of Domonick Ponciana said it took place on Dec. 8.

A witness said he walked over to 1229 East Scott Avenue  with Ponciana to retrieve his vape that he left there earlier.

Ponciana and Miller got into a discussion about gang talk about what weapons they carry. Ponciana said he usually carries a knife, and Miller cocked his gun and said “we use guns in my gangs and why not?

Miller then pointed the gun at a girl, then turned around and struck another girl in the jaw with the gun while in the dining area of the house. Ponciana said “What’s that for?” at which time Miller started shooting Ponciana as he tried  to get away by going through the kitchen and a small room behind the kitchen, where the witness said he went down.

Miller continued to fire shots. The witness said he saw a lot of blood on Ponciana’s face and the homeowner told everyone to leave. The witness said Miller’s gun looked like a gray 9mm semi auto. Ponciana remains in critical condition at OU Medical Center.

The State of Oklahoma filed four charges against Miller on Tuesday and a warrant was issued for his arrest. Kay County District Court also set Miller’s bail at $2.5 million.
