Ex-Pawhuska Coach Seeks Dismissal Of Charges

PAWHUSKA, Okla. (AP) – A judge is considering a request to dismiss embezzlement charges filed against a former football coach at Pawhuska High School.

Attorneys for Scotty Ray Gilkey have filed a motion of dismissal, arguing that Osage County doesn’t have jurisdiction to prosecute the case because Gilkey is one-quarter Pawnee Indian. Gilkey’s attorneys submitted a Certificate of Indian Blood last week, but prosecutors say it’s not enough to prove tribal citizenship.

The Examiner-Enterprise reports (http://bit.ly/1ckOS5l ) that the motion hearing began last week and is set to resume at 9 a.m. on Jan. 17.

Prosecutors accuse Gilkey of embezzling more than $2,500 from a fireworks stand that was supposed to benefit the Pawhuska football team. His attorneys dispute that claim.
