Mental exam ordered for Oklahoma man charged in girl’s death

McALESTER, Okla. (AP) – A judge in Pittsburg County has ordered a mental evaluation for a 21-year-old man charged in the death of his toddler daughter.

District Judge James Bland ordered the evaluation Friday for Devin Sizemore, who is charged with first-degree murder in last month's death of his 21-month-old daughter, Emily Sizemore. Police say that Emily Sizemore was found unconscious in a pond in Krebs and was later pronounced dead at a hospital.

Bland ordered the court case stayed until the evaluation is complete. Sizemore's attorney, Matthew Sheets, requested the mental competency evaluation, writing in court papers that Sizemore is unable to assist him in preparing his defense.

First Assistant District Attorney Chuck Sullivan tells the McAlester News-Capital (http://bit.ly/2axiKoP ) that prosecutors are still determining whether to seek the death penalty in the case.
